December 19 · Jeanne SchnitterJune of 2017 I closed on a home and Denise was the listing agent. Its a miracle that I was able to close after all of the unecessarily stressful events that occurred while trying to work with her. Every step of the way was a significant obstacle. I have never seen such a lack of respect and professionalism in a real estate transaction, or any other deal in my life.I saw a home that I loved, therefore I immediately told my broker to put in an offer for me. He called Denise and my offer was accepted and so my broker continued to coordinate the transaction with Denise. Denise sent over a sales agreement that was $10,000 over what I offered so, not thinking much along the lines of foul play, I informed my broker and he was able to revise it with the originally stated price; that was strike one.I had the house inspected immediately and the inspector presented me with a list of items (ancillary and cosmetic for the most part) that he believed needed improvements. In order to assure a swift and smooth transaction, I proposed that the seller grant me a credit instead of complete any work. Denise communicated that the seller was a builder, therefore he "wouldn't be offering any credits." I continued to negotiate and asked that she present the punch list to the seller. My broker was able to uncover the fact that Denise did not present my punch list for weeks and kept telling us what could and couldn't be done on her own accord. We couldn't understand why. This particular seller was a contractor so, the punch list items I presented could have been completed in half a day's time. I was sensing that she was not communicating any of this to the seller, which allowed for more time for her to keep showing this house; even after my offer was accepted. I kept receiving "open house" notifications in emails for a few weeks.The most troublesome and appalling event that occurred during this transaction was two weeks before closing. There obviously was a contract initialled and signed by the seller and myself with my broker's name listed. My broker and lawyer informed me that Denise communicated to the seller's attorney that she had no idea he was my broker...but theyd been working together the entire time; this was just unthinkable, even after all the rest of the unprofessional events that occurred. This seemed like some type of scam to me so I took the liberty of researching and calling the seller myself to inform him of the timeline of events (plus more) that had occurred during the transaction to that point.The seller was a kind gentleman who listened to all that had happened and agreed to meet me at the house to go over anything I had concerns about. The first thing he did was offer me a credit! In addition, we agreed he would fix some cosmetic items and he did so the very next day. Therefore, I knew my requests had not been communicated, as there is no way a contractor who takes pride in their work, doesn't fix obvious flaws. I should have called him at the first sign of trouble.Finally, just an hour before the closing. My lawyer called and informed me that the seller's side had threatened not to close if we did not take the broker's name off of the closing documents. I closed on my co-op two days before this closing and I would have had nowhere to go. I was esentially held hostage. I don't see any other reason this would have happened other than pure greed. In what real estate deal does a buyer's broker not get paid, especially when his name is listed in the executed contact? Just flat out unbelievable; obviously I never saw that coming.I am stating the facts and timeline of events that occurred during my transaction in hopes of preventing a similar experience for another potential buyer. Be extremely careful if you decide to do business with this woman. One of the first things she mentioned to me, is that she has been in business for over 20 years. That leads me to believe this isn't the first time she has tried to pull something like this. We'll see how it plays out in court.
